Terms of use
The terms for using phonique.com and the Phonique app, and the licence for the templates.
1. About these terms
These terms are an agreement between you and nthState Ltd, the company that makes Phonique. They apply when you use the website at phonique.com, the Phonique app or the templates.
nthState Ltd is registered in England and Wales under company number 05571737. Its registered office is at Rycroft, School Road, Broughton, Huntingdon, Cambridgeshire, PE28 3AT, and you can reach it at contact@phonique.com.
What we do with your data is in our privacy policy.
2. The Phonique app
Apps on the App Store are licensed, not sold. Your licence to use Phonique is Apple's Licensed Application End User License Agreement, which you accept when you get the app, and these terms add to it.
3. Buying Phonique
Phonique is sold only through the App Store. Apple shows you the price before you buy, takes your payment and handles refunds, under the App Store's terms.
One purchase covers Phonique on the Mac, iPad and iPhone, for the Apple Account you buy it with.
4. What you make
Your projects, your recordings, the sounds you render and the Swift code Phonique exports for you are yours. We claim no rights in them.
The Swift code Phonique writes when you export a project is yours to use, change and ship in your own apps, whether they are free or paid, with no need to credit us.
Use only audio you have the right to use. You are responsible for the audio you put in a project, and for what you ship.
5. The template licence
The templates are the projects we make for you to start from, in the app and on this website: their graphs, spaces and audio, the previews on their pages, and the Swift code Phonique exports from them.
You may use the templates in your own apps, free of charge, whether your app is free or paid. You may change them, take them apart, combine them with your own work and ship them in what you make, and you do not need to credit us.
The templates come as they are, with no promise that they suit any purpose.
6. Using this website
You may read, link to and share the pages of this website, and use the pictures in its press kit to write about Phonique.
The words and pictures on this website belong to nthState Ltd, apart from the names and marks of others. Its typefaces, Bricolage Grotesque, Instrument Sans and JetBrains Mono, are used under the SIL Open Font License, whose text the website serves beside them.
Do not use the website in a way that harms it or anyone else, such as trying to break into it or to overload it.
7. Names and trademarks
Phonique, its icon and its wordmark are trademarks of nthState Ltd.
Apple, App Store, AirDrop, Apple Pencil, Apple Vision Pro, iCloud Drive, iPad, iPhone, Mac and Swift are registered trademarks of Apple Inc., and iPhone Duo is a trademark of Apple Inc. Phonique is an independent product and has not been authorised, sponsored or otherwise approved by Apple Inc.
8. Our responsibility to you
Nothing in these terms limits a liability the law does not allow to be limited, such as for death or personal injury caused by negligence, or for fraud, and nothing in them affects your rights as a consumer.
Apart from that, we provide the website and the templates as they are. We are not responsible for losses we could not reasonably have foreseen, or for losses to a business.
9. Changes to these terms
When these terms change, we publish the new version on this page, with the date it takes effect at the top. A change applies from that date.
10. The law that applies
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland you may also bring proceedings there, and if you live elsewhere you keep the protection of the mandatory laws of the country you live in.
